Copyright Claim on YouTube: How to Appeal

YouTube is the world's largest platform for video content and live-streaming. Every day YouTube faces thousands upon thousands of copyright infringement issues due to videos containing music or video content that the uploader did not have permission to use. As a result of this, YouTube created Content ID, an algorithm that can scan all videos that are uploaded to see if someone else's song or video is in them. If so, a copyright claim will be issued against the video.

If your YouTube video receives such a claim, known as a Content ID claim, you can dispute this claim. Before disputing a Content ID claim, you must have a valid reason to do so. Some of the reasons YouTube accepts include:

  • Having all the necessary rights to the content in your video

  • Using the content in a way that qualifies as a copyright exception, such as fair use (fair use is a legal exception to copyright which you can read about more in our blog, "An Overview of the DMCA" under the heading "DMCA Exceptions and Exemptions")

  • Believing your video was misidentified or an error was made.

Some reasons that are not acceptable include:

  • Giving credit to the copyright owner

  • Owning a copy of the video or song under dispute

  • Choosing not to monetize the video.

If you still believe that you have all necessary rights to the claimed content, submit a dispute by logging into YouTube Studio, heading over to the content section and finding the video with the Content ID claim. From there, fill out their simple form to submit your dispute. If you do not have a valid reason to submit a counterclaim, you should not submit one. Unless you have permission from the owner or rightsholder of the music (or copyright exception applies), you are not allowed to use the song. There is no way around this.
