Free Music License for Retail Stores / Shops

Do I need a license to play music in my store?


Yes! Licensing music for retail locations is mandatory and there is no way around this. Any sort of background music requires a license. A music license for your store can be obtained from the owner of the song themselves, or otherwise, licenses are most commonly obtained from a performing rights organization (PRO), such as BMI or ASCAP in the United States or SOCAN (Canada) or SESAC (Europe). Otherwise you can buy a blanket license to use music from all PROs (but this can become very expensive). And if you want to have live music performed at your store, additional fees must be paid for the right to perform the music.


Can I play my own music?


It should be noted that you are not allowed to play your own music, even if you have legally purchased it. Nor can you stream music without a license. A license is needed to play, stream, or perform any sort of music at your store (any public performance of music requires a license).


How much are music licensing fees for stores? How are they calculated?


Licensing modern music from PROs costs anywhere from hundreds (for small stores) to thousands of dollars per year (for larger stores or retail chains). The more PROs you want a license from, the higher fees become. Each PRO's fees are calculated based on a number of factors, including the size and capacity of the location and the number of speakers present. If the store ever hosts live performances, there are additional fees. While this can be expensive, especially for retail chains with dozens or even hundreds of locations, failure to pay for a music license can be even more expensive.


What is the penalty for playing music at my retail store / shop without a license?


Fines for failure to obtain a music license can be thousands of dollars or more, with the maximum statutory fine being $150,000 per song, not to mention the costs of an expensive lawsuit (attorney and court fees). PROs regularly send representatives to shopping malls and retail shops and stores in order to check whether music is being used without a license. They have song-detection software similar to Shazam, and will sue businesses that are using songs without a license.
