Free Music License for Gyms / Fitness Clubs

Updated: Sep 24

Nothing complements a workout better than an awesome, high-energy playlist to push you to the max. Music is an essential component to create the perfect gym atmosphere for your clientele. In this article, you can find out how to legally play music at your gym or fitness club / facility without the risk of expensive fines. And you can find out how to do this for free!

Do I need a license to play music at my gym or fitness club? Or during fitness classes?

Licensing music for gyms or any sort of fitness facility or class is mandatory. This license requirement extends to yoga studios, F45, Orange Theory, spin class, crossfit, martial arts, aerobics, Zumba, dance, all sports training facilities and any other sort of exercise-related or training facility. The license grants permission to use the music in a business setting (in this case at your gym or fitness facility).

How to license music for a gym or fitness club?

A license can be obtained from the owner of the song themselves, or otherwise, licenses are most commonly obtained from a performing rights organization (PRO), such as BMI or ASCAP in the United States or SOCAN (Canada) or SESAC (Europe). A PRO is an organization that represents many different songwriters and owners. Millions of artists are represented by these PROs. Each PRO has a different music licensing fee, and if you want to play songs by artists who are represented by different PROs, you will have to pay fees to each PRO. Otherwise you can buy a blanket license to use music from all PROs (but this can become very expensive).

How much does a gym or fitness club music license cost?

Licensing modern music from PROs costs anywhere from hundreds to thousands of dollars per year. It becomes more expensive when you want to license music from multiple PROs. The particular cost is different for every gym and depends on a few factors. First, it must be determined whether or not the music you are playing is “background music” or if it is being played in an “active” setting, such as a group fitness class. Each requires a different license. Background music is cheaper, and will usually cost a few hundred dollars per year for smaller gyms and over a thousand for larger gyms. Background music fees are calculated based on the size and capacity of the gym as well as the number of speakers set up. If you are playing the music in an “active” setting (all individual or group fitness classes are considered “active” settings), fees will be much higher, and will also factor in the number of attendees and number of classes being held.

What is the penalty for playing music at my gym without a license?

While licenses cost a lot of money, failure to obtain a license can be even more expensive. Fines for failure to obtain a music license can be thousands of dollars or more, with the maximum statutory fine being $150,000 per song, not to mention the costs of an expensive lawsuit.

Copyright infringement lawsuits are extremely commonplace and appear in the news all the time. And it isn't just bricks and mortar locations that need to worry about music licensing. Virtual fitness classes are also under the same obligation to purchase a music license or face the same penalties. For example, Peleton was recently sued for $150 million for alleged copyright infringement for using popular music in their virtual fitness classes without a license.

PROs regularly send representatives to gyms and fitness clubs / classes in order to check whether music is being used without a license. They have song-detection software similar to Shazam, and will sue businesses that are using songs without a license.

Can I play my own music?

No! You are not allowed to play music that you have purchased yourself, nor can you stream music. In fact, you can't even perform your favourite songs to entertain your clientele. A license is needed to stream, perform, or play any sort of music at your gym or fitness club.
